About Joe Payten

Joe is an experienced commercial litigator.

He has spent his career working with clients to navigate and resolve their most complex commercial disputes, including class actions, technology disputes, regulatory enforcement matters, professional negligence claims and antitrust litigation.

Joe has broad experience across a range of sectors, with particular experience in the technology, banking and financial services and industrials sectors.

Having spent five years as a litigator with Linklaters in London, and six months on secondment at the London offices of a global US-headquartered investment bank, Joe brings a global lens to his practice. He is admitted to legal practice in England and Wales as well as Australia. 

Joe grasps technically complex matters quickly, and clients benefit from his calm, pragmatic and commercial approach to dispute resolution.

Joe's recent experience includes advising:

  • Epic Games: in two Federal Court proceedings against Apple and Google alleging misuse of market power and other anti-competitive conduct in respect of mobile app distribution and in-app payment systems. This is the first big tech antitrust litigation in Australia and involved complex expert evidence from a range of disciplines including technology, security, payments, antitrust economics, econometrics, behavioural economics and forensic accounting. It involved a 16-week trial and included two related class actions.
  • Citibank: in its defence of class action proceedings in the Federal Court alleging anti-competitive conduct in respect of the sale of FX instruments.
  • KPMG: in the defence of various investor and shareholder class actions, including arising out of the collapses of Gunns Limited and CuDeco Limited, and in public examinations.
  • Australian and multinational organisations in regulatory investigations by a range of investigating agencies including ASIC, the AFP and the OAIC, and enforcement proceedings, including in the successful defence of the Chairman of an ASX-listed entity in high-profile disqualification proceedings commenced by APRA.
