About Kirsty Prinsloo

Kirsty specialises in restructuring and corporate insolvency, commercial litigation and regulatory investigations.

Kirsty advises insolvency practitioners, creditors and other stakeholders in connection with distressed situations including contingency planning and safe harbour plans, formal and informal insolvency processes, restructurings and workouts.

She has received independent recognition from Legal 500 as being 'extremely capable and hard working' and was named by Lawyerly in 2021 as a 'Litigation Rising Star'.

Kirsty's recent restructuring and insolvency experience includes:

  • Quintis group – acting for the bondholders and receivers of the Quintis group, including in relation to the recapitalisation of the business through a deed of company arrangement and a creditors' scheme of arrangement.
  • LJ Hooker group – advising Infrastructure Capital Group in relation to a debt restructure implemented through deeds of company arrangement.
  • Presbyterian Church of Queensland – acting for the Court appointed receivers of the Presbyterian Church of Queensland in relation to the sale of aged care facilities.
  • RCR group – acting for McGrathNicol as liquidators in respect of issues arising from the collapse of the group.
  • Big Four Banks – acting and advising the Big Four Banks in relation to various workouts and enforcement actions of various loans provided to distressed borrowers in a number of sectors including professional services, pharmaceutical, resources and retail.

Kirsty also advises a range of clients in relation to commercial disputes across a range of industries including financial services, retail and agriculture. Her recent commercial litigation experience includes:

  • Westpac Life Insurance class action – acting for Westpac in defending a class action involving the premiums associated with life insurance including a successful appeal in the High Court of Australia in relation to common fund orders (Westpac Banking Corporation v Lenthall [2019] HCA 45).
  • Dick Smith group – acted for a former non-executive Chairman in successfully defending claims brought by the group's receivers for alleged breaches of directors' duties (DSHE Holdings (Receivers & Managers Appointed)(In Liquidation) v Nicholas Abboud (No 3) [2021] NSWSC 673).
  • ASIC proceeding against Westpac – acting for Westpac in defending proceedings brought by ASIC involving allegations of insider trading.
  • CDPP prosecution – acted for Pershing Securities Australia Limited (subsidiary of The Bank of New York Mellon) in relation to a prosecution brought by the CDPP for breaches of client money obligations.

Kirsty also advises financial institutions in relation to a range of regulatory investigations.
